Clinical Research Industry Issues Essay

Services in the business sector becomes troublesome when customers seem to act too superior when dealing with the company’s employees (Bassett 25). Companies which disseminate excellent customer service definitely excel in the market (Bassett 26). There are plenty of physicians who run out of patients to treat, and still, there are a lot of patients who search for the right physicians (Rizzo & Sindelar 968). Physicians enter into a competitive market within the consumer population by trying to put the best medical practices forward in the market of consumer population (Rizzo & Sindelar 968). These medical practices are what make the physicians stand out among the patients (Rizzo & Sindelar 968). Patients may decide to seek the services of a different physician due to relocation reasons (Rizzo & Sindelar 968). Patients also may change the physician that they are seeing due to the fact that their previous physician is not able to disseminate the quality level of services that the patients are seeking (Rizzo & Sindelar 968). Wider government services are of no use to be implemented as aid to pharmaceutical operations if the pharmaceutical industry would not adjust its degree of services to public needs (Olson 304). The pharmaceutical industry needs to work hand in hand with other health care provider companies so that it would be able to improve its services to the public (Olson 304). The pharmaceutical industry needs to work more closely with physicians in order to better improve its services. The pharmaceutical industries would be able to obtain advice from physicians regarding the following matters: Clinical Research Industry Issues 3 1. The rampant illnesses that patients possess. 2. The common types of medications that patients are prescribed to. With this information gathered by the pharmaceutical establishments from physicians, the pharmaceutical establishments may be able to provide better services to the patients. Literature Review 2. Ethical And Policy Issues In Research Involving Human Participants It is of utmost importance that the welfare or well-being of the human participants be given consideration when conducting a research (Jones 97). It is required that every researcher declare the progress of his/her report to a research study agency as outlined in a particular research’s ethical guidelines (Jones 97). 3. Research Involving Persons With Mental Disorders That May Affect Decision- Making-Capacity Researches on the origins of mental disorders refer to neurobiological elements as their causes (Walsh, Green, Matthews & Puerto 43). Sixty one percent of the participants that have been studied on these researches unanimously states that a person with a high level of mental illness inherits the illness from a mentally ill parent (Walsh, Green, Matthews & Puerto 43). 4. Bias In Pharmaceutical Sponsored (Funded) Clinical Trials Clinical Research Industry Issues 4 The pharmaceutical industry may become biased when sponsoring clinical trials. They may actually tamper with the results of the clinical trials to make it appear that the participants are sick even when they are not, just to increase the pharmaceutical industry’s sales. 5. Relationship Between Clinical Investigators And The Pharmaceutical Industry At times, the executives of the pharmaceutical industries bribe the clinical investigators in order to tamper with the results of the clinical trials. This is an unethical and legally violating event that takes place sometimes 6. Corporate Hand In Clinical Trials And Their Contracts With Medicine Academia The corporations usually consult the medicine academia for sources and aid in order to facilitate their clinical trials at the highest level of quality. Diplomatic Immunity

The importance of developing friendly intercourse between members of international community which is one of the avowed aims of the United Nations, necessitate the establishment of diplomatic relations between nations. As the complexity of international affairs increased and the interdependence of nations grew, countries recognized both the convenience and necessity of maintaining resident envoys abroad. A code of diplomatic procedure was developed and has become part of the law of nations. On 18 April l961, the United Nations Conference on Diplomatic Intercourse and Immunities adopted the Vienna Convention on Diplomatic Relations, hereafter called the â€Å"Vienna Convention†, which codified the law on the subject (Salonga, J. & Yap, P. l966 p. 252). Diplomatic persons have been accorded since ancient times special privileges and immunities on the necessity of permitting free and unhampered exercise of diplomatic functions and of maintaining the dignity of the diplomatic repre sentative and the nation he represents. However, the Vienna Convention clearly expressed that those who enjoy the privileges and immunities have the duty to respect the laws of the host country. Although inadequate, diplomatic immunity provides a means to forestall active hostilities that might arise between nations. Discussions/Analysis The person of a diplomatic envoy is inviolable. A diplomatic agent, official family members and his administrative and technical staff may not be subpoenaed as a witness, arrested or detained, prosecuted and residence may not be entered subject to ordinary procedure. The United Nations Organizations and other international bodies also enjoy the right of legation and are accorded diplomatic immunity by receiving nations. Nonetheless, without prejudice to the privileges and immunities, diplomatic personnel are not exempt from legal responsibility for infractions committed under the local laws of the receiving country. For death and injury committed, the receiving country may request the sending nation to waive the immunity of a diplomatic agent. Gueorgui Makharadze, a deputy ambassador of the Republic of Goergia to the United States was convicted by the U. S.  for causing the death of a sixteen-year-old girl and wounding four others in a car accident. As a diplomat, he was released from custody, but the Georgian government waived his immunity when the U. S. government asked for it (Frieden, T. & the Associated Press 2000). Less grave offenses, however, are being dealt with administratively by the sending State as in the case of theft. Mexican embassy asked a Mexican press attachà © Rafael Quintero Curiel to tender his resignation upon arrival in Mexico City when he was caught through a surveillance video stealing blackberry PDA units from a White House press meeting room.He was caught up at the airport by the United States Secret Service and was about to leave. He claimed diplomatic immunity and left (. Rosen, James, Max Emanuel & the Associated Press). Exemption from taxation by the receiving State is held to be part of the â€Å"non-essential† prerogatives of diplomats, granted to them only as a matter of comity or courtesy. A diplomatic envoy however is not exempt from charges levied for specific services rendered. An example of this is the charge on cars entering central London. There are reports that diplomatic immunity has been used to avoid payment of traffic fines reaching to several million pounds. There are embassies who agreed to settle their accounts. Londoners welcome the move of the United Arab Emirates to settle  £99,950 of traffic fines and hope that the U. S. government will follow the move made by UAE (â€Å"Embassy to pay†). The premises occupied by a diplomatic mission are also inviolable. The agents of the receiving State may not enter such premises without the consent of the envoy, except in extreme cases of necessity such as when the premises are on fire or where there is imminent danger that a crime of violence is about to be perpetrated on the premises.Such premises cannot be entered or searched and neither can the records and archives be detained by local authorities even under process of law. Premises of global organizations are also inviolable. Recently, the World Intellectual Property Organization (WIPO) become the center of controversy when Geneva police entered the Geneva headquarters of the international patents agency to collect evidences in the alleged smear campaign against WIPO’s deputy head, Francis Gurry, following his complaint filed. The police authorities get rid of diplomatic immunity when they entered the premises of an international body to greet DNA samples from ten employees of the said organization as reported by the Tribune de Genà ¨ve. To allow the investigation to proceed, the Swiss government assented earlier to lift the diplomatic immunity from the 10 WIPO diplomats (Curtis, M. 2008). Diplomatic privileges and immunities may be waived, but as a rule, the waiver cannot be made by the individual concerned since such privileges and immunities are not personal to him.The waiver may be made only by the government of the sending State, in the case of UN International agencies; it is the member nations that could waive the immunity. Summary/Conclusion Diplomatic agents are entitled to privileges and immunities, such as: personal inviolability, inviolability of premises and archives, exemption from taxes and customs duties, exemption from local jurisdiction, etc. Privileges and immunities however, are not without limitations; envoys are not immune from legal liability. The host country may request the sending State expressed waiver of immunity or can declare persona non grata a diplomat or any member of his family who commit serious crime. Though immune from local laws, he can be recalled and prosecuted under his own country’s justice system. An envoy is immune from the criminal and saves i n certain cases, the civil jurisdiction of the receiving State for all acts, whether official or private. Thus he cannot be arrested, prosecuted and punished for any offense he may commit, unless his diplomatic immunity is waived. The procedure in cases where an envoy is guilty of a serious infraction of laws is to ask for his recall. Immunity from jurisdiction, however, does not mean exemption from the local law. It does not presuppose a right to violate any of the laws of the receiving State. They are not liable to be sued unless they submit to the jurisdiction. Diplomatic immunity does not signify immunity from legal liability but only exemption from local jurisdiction.

The Best Experience of My Life

One of my favorite family traditions is summer vacation. Every summer without fail we go on vacation, and we stay there for at least a week. For the past five years we have been going to Disney World with our family that lives in Los Angeles. He is my cousin Ricardo, he lives with his wife and his 1-yearold daughter. I like them because they’re nice, cool and funny. It has turned into a tradition and we all love to be together and have a good time. Every year when we go they greet us in such a way they make you feel like home. Once we’re there and our vacation starts we just forget about everything and relax for a week. We have been going on vacation with our cousins for so long, for a very good reason. It is because everyone gets along. My mom and dad, Ricardo and his wife Mari have a very good relationship. Ricardo my cousin, who is 30, is my cousin and my friend and we get along great. My sister Susan, who is 25, and Mari, who is 27, also get along very well. This works out great because we are all old enough to go out and do our own thing without getting the parents too much involved. Since most of the fun things to do are located right near the hotels we stay at any random hotel. We rarely need to ask them for a ride anywhere, so everyone goes their way and it turns into a great vacation for all of us. We have been going to Disney World together for as long as I can remember. We know the place inside and out. Where all the best rides are, which park is the best. It even got so bad that we knew what time the lines for each ride was shortest. Disney World always comes out with some kind of a new ride or show each year . All the characters are the same but they’re always happy and cheering for the little kids. So it doesn’t gets boring, that is what mostly keep us continuing coming back for more year after year. We headed for the food court because we were all very hungry. All I had eaten in the entire day was water a sandwich and a piece of gum . It was getting late and we hurried because we planned to go to the rides last. When we arrived at the restaurant me and my sister ordered a gigantic hamburger, my mom and dad fish, and my cousin and his wife chicken. When we finish we were all very satisfied and we headed for a little fun. We saw some lights in the far end and we followed them. We arrived at a show it was called the electrical parade and it was really cool. So we went down there last summer and it was a big vacation for all of us. I know it was more of an children’s vacation which but it was very fun and we all loved. In my opinion we are a little too old for Disney World but it was my favorite vacation. My favorite part was when we went to the rides and got on a rollercoaster. My sister tried not to vomit but I guess she had a weak stomach and vomited all over my dad. Unfortunately for my dad, he was on the same cart and he vomited too. When it all was over and we were in a hotel we joked about the vomit and laughed really hard. We shouldn’t had eaten right before going into the rollercoaster.

America and Vietnam Essay Example for Free

America and Vietnam Essay Olsen and Roberts are both history professors who are fascinated with the ways by which the American government made the situation of the war with Vietnam a fearful yet victorious even for the reputation of the said country. The authors were then able to contribute their thoughts about the situation thus seeing the situation of the past wars a manifestation of the reputation of the American society in the world account of recognized countries of war and reconciliation. Their book â€Å"Where the Domino Fell† actually pictures the actual situations that happened during the American-Vietnamese war during the 1960’s and how the said history particularly affects the relationship of the two countries involved. About the Book [Content and Summary] The overall content of the book is highly recommended for reading and teaching as it gives a clear yet critical approach in assessing the US policy that controlled the Vietnam society from then until the present. Undeniably, the book of Olsen and Roberts is an awakening material that helps the human mind realize the importance of being diplomatic and lawful even when in the middle of distress. Surprisingly, the American society was able to steel a fine reputation out from all the oppression that they have already implicated upon the Vietnamese society during the war years. Through the critical assessment of the situation, the authors intended to give the readers a fine picture not only of what is or what has been obvious but also a glimpse of the truth behind the scenes of historical accounts written in books today. Implications of the Reading As it has been noted earlier, the reading gave a clear depiction of what has happened and why the said events happened during the American-Vietnamese war in the 1960’s. With the insightful informations that the authors posted through their book, they were able to help readers realize what the facts are and how they particularly affect the present relationship that exists between the said countries. Critique of the Writing Approach As for the writing approach of the authors, it is undeniable that the informations that they posted through the reading were carefully assessed thus giving out validated facts that support their explanations of the said historical event. The clarity of the implications of the reading has been strengthened by the documentations that the authors used to show the authenticity of the reading. The utilization of other researches that supported their claims and opinions made the book a must read not only for professors and students, but also for those individuals who endeavor reading books under the typical yet critical approach of understanding history and American politics. Within the context of the book lies a less-traveled path among the historians of the present times. Olsen and Roberts certainly made it clear that history is a human account needed to be understood and learned from through critical observation of the past. Reference: James S. Gender discrimination Essay Example | Topics and Well Written Essays - 1250 words - 1

Gender discrimination - Essay Example Traditionally, men had better opportunities in life; but this has changed with modern girls and women having better opportunities albeit with many challenges than women in the past (Girls Inc 1). Feminist advocates have fought against social traditions and cultures that devalue and treat women as lesser human beings, and they have achieved valuable gains all over the world (Chesler 3). Their fight has highlighted some of the challenges and disadvantages women continually face. This has made it possible for the legislation of laws against gender discrimination. In the modern world, prestigious and powerful positions are obtained through quality education and this has traditionally been used to deny women these positions. In the past, education for boys and girls was different with women being predominantly trained on child rearing and housekeeping despite being intelligently at par with men (Deberg 1). This practice still exists in some parts of the world where the girl child is denied education based on worthless religious, social, or cultural norms. Without an education, women are restricted to low paying unskilled positions; and when married become inferior to the male who provide everything. This lack of independence is discriminatory and purely meant to make women submissive to the men. The modern woman, however, is sexually discriminated in employment promotions, benefits and leaves of absence because of her gender with the majority of the populace in the society having entrenched mentalities that women are the weaker sex supposed to be under the dominion of their male counterparts. The society has developed cultures based on the biological differences between men and women with each gender having specific roles, responsibilities, and expectations to be fulfilled (Haeberle 1). These cultural roles are discriminatory to women who are only

Final Project Essay Example | Topics and Well Written Essays - 1500 words - 2

Final Project - Essay Example In order to transform vision into opportunity, it is necessary that that vision is first transformed to the functional level because it would otherwise be difficult to gather and motivate employees if something is forced onto them from the top. (Kotelnikov). Thus in order to convert the vision into opportunity, first thing which must be taken into account is the fact that whether the proposed change would be acceptable down the line and if not then what top management of the organization have to make it acceptable within the organization. The administrator’s decision to turn vision into opportunity is what leaders are known for. A good manager and a good leader always create opportunities. Since the competitive environment where low cost service providers are already there with good market penetration, it takes a lot of courage to turn the competitive threats into the opportunities for the organization. For a flexible organization, the strength of the organization is in the fact that how swiftly and quickly it can convert its vision into opportunities and opportunities into real time business actions to derive value for the organization. â€Å"The structure of an organization is the manner in which various sub-units are arranged and inter-related.† (FAO) Therefore considering the above action of the administrator to covert the vision into opportunity is going to have a strong impact on the organizational structure. There are various organizational structures ranging from line structures to more complex organic structures of the organizations. From the given information, it seems that the organization has a functional structure and it is going to have most impact with the decision of the administrator to go for the provider based services. Since this kind of organization has to rely on the technical skills of its various staff therefore a functional structure would be most affected. In order to assess the

MelaFind Technology Cutting Backon Melanoma Biopsies Essay

MelaFind Technology Cutting Backon Melanoma Biopsies - Essay Example This device is not a screening device and is only used when the mole looks irregular and the dermatologist needs more information. This technology will apply to people with skin moles that are accessible for use by the machine, patients with clinically atypical cutaneous and pigmented lesions in the skin, patients with moles that are sufficiently pigmented, and those without fibrosis or scars from previous trauma (Nasir et al 128). It also applies to patients with intact skin and whose mole is over 1 cm from their eyes, and those who do not have moles on anatomic sites like genitals, lips, feet soles, and their palms. MelaFind will improve quality and delivery of healthcare because it has been impossible to tell about the harm posed by moles without invasive surgical biopsies. The device now helps the dermatologist to make the correct call with regard to whether invasive surgery is required (Nasir et al 129). It gives additional information to the doctor to reduce the patients that would otherwise have been left with scars that are unnecessary from the biopsy, while also reducing unnecessary procedure costs. In the future, the device can be designed to identify colorless melanomas, large melanomas, as well as squamous and basal cell carcinoma. In addition, its specificity could be improved because it still has a problem in differentiating hypothetical pregnancy tests and non-melanomas (Nasir et al 130). This will improve its ability to reduce the high rates of false
